Apex Experience Booking Policy and Terms of Service

Important Notice: By submitting a booking request and completing payment through the Apex Experience website or booking system, you (the "Lessee" or "Customer") acknowledge that you have read, understood, and agree to be bound by these Booking Policy and Terms of Service (the "Agreement"). This forms a legally binding contract between you and Apex Experience. If you do not agree, do not complete the booking. These terms comply with Alberta's Consumer Protection Act and incorporate all mandatory consumer protections. You should print or save a copy for your records. Questions? 1. Parties

Lessor: Apex Experience, Lloydminster, AB telephone 825-962-0445, email contact@apexexperience.ca.

Lessee: The individual or entity submitting the booking (you).
2. Services and Equipment
Apex Experience provides mobile racing simulator rental services, including delivery, setup, and pickup of professional-grade racing simulator equipment (the "Equipment") for temporary entertainment use at your specified location. The Equipment includes one (1) full racing simulator rig (console, monitor/TV, steering wheel/pedals, seat, and accessories), valued at approximately $2,500 CAD. Services are for personal, non-commercial use only. You must provide a suitable indoor space with power access and ensure safe, supervised operation.
3. Booking Packages and Rental Period Upon booking, select from:

Sprint Session: 2 hours.

Circuit Challenge: 4 hours.

Grand Prix Glory: 8 hours (full day). The Rental Period commences at the scheduled start time. Extensions available at $60 CAD per hour with prior approval. Travel fees: Free within 10 km of Lloydminster; $50 CAD for 10-30 km.
4. Payment Payment is due in full (inclusive of GST/HST, in CAD) at booking via [e.g., credit card online]. Rates:

Sprint Session: $149 CAD + GST.

Circuit Challenge: $249 CAD + GST.

Grand Prix Glory: $399 CAD + GST. Plus applicable travel fees. All payments are final except as outlined in Section 9 (Cancellation). You are responsible for all taxes and charges.
5. Use of Equipment You agree to:

Use the Equipment only for intended racing simulation entertainment, in a careful, lawful manner, per manufacturer guidelines and local laws.

Not modify, disassemble, or attach items without consent.

Supervise users (minimum age 12; those under 18 require adult supervision; no use under influence of alcohol/drugs).

Keep the Equipment at the specified location; no subletting or commercial use. Breach constitutes default.
6. Maintenance and Care You will maintain the Equipment in good condition (normal wear excepted) and report issues immediately. Apex Experience handles maintenance outside the Rental Period.
7. Loss, Damage, and Risk of Loss You assume all risk of loss, theft, damage, or destruction to the Equipment during the Rental Period (from any cause, including if unattended). You will:

Notify us immediately in writing of incidents.

Pay for repairs or replacements at your expense.

For total loss/theft/irreparable damage, pay Casualty Value ($2,500 CAD). You are liable for all damage (e.g., spills, impacts, misuse), reimbursing us for costs plus $100 CAD minimum admin fee. Normal wear (e.g., fingerprints) excluded.
8. Insurance and Indemnity Apex Experience maintains business liability insurance. You are encouraged to have homeowner's/renter's insurance covering the Equipment and provide proof if requested. You agree to indemnify and hold harmless Apex Experience, its owners, and agents from all claims, losses, damages, liabilities, and costs (including legal fees) arising from your use of the Equipment/Services, including third-party injuries or property damage, to the extent permitted by law.
9. Cancellation and Rescheduling

Cancellation: Full refund if 24+ hours before start. Cancellations within 24 hours incur a $25 CAD fee (non-refundable).

Rescheduling: Free if 6+ business hours before start. Requests within 6 business hours incur a $25 CAD fee. We may cancel for force majeure (e.g., weather, illness) with prompt rescheduling.
10. Termination and Default We may terminate immediately for default (e.g., non-payment, misuse) and repossess Equipment; all Rent becomes due. Defaults include breach, insolvency, or seizure. Remedies include accelerating payments and collection costs.
11. Warranties and Disclaimers We warrant the Equipment is in good working order at start. EXCEPT AS STATED, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY OR FITNESS. We are not liable for indirect, consequential, or special damages.
12. Governing Law and Disputes Governed by Alberta and federal Canadian laws. Disputes resolved first via mediation in Lloydminster; then Alberta courts. Prevailing party recovers costs. Conflicting clauses amended to comply with law (e.g., Consumer Protection Act).
13. General

Entire Agreement: These terms are the full contract; no oral changes.

Severability: Invalid parts do not affect others.

Assignment: You may not assign without consent; we may.

Notices: Via email or registered mail.

Binding: Applies to heirs/successors. Time is essential.

Cooling-Off: If applicable as a direct sales contract, you have 10 days to cancel with full refund (excluding delivery costs).
